CTOnews.com Sept. 5, September 1, Shanghai intellectual property Court took the lead in announcing a result of protecting the audio copyright of Tencent's "three-body" audio.

In this case, in 2019, Tencent obtained evidence through the Internet, believing that there were a large number of "three-body" audio content uploaded by anchors in Litchi App, so it filed a lawsuit with the people's Court of Pudong New area in Shanghai. According to the documents, the plaintiff Tencent claimed that it signed an exclusive cooperation agreement with Liu Cixin, the author of the novel "three-body" in May 2016, and Liu Cixin issued a power of attorney, and the plaintiff had an exclusive license to record "three-body" into audio works. The defendant litchi company provides a large number of unauthorized three-body audio novels online listening, playing, caching and downloading services through its official website and "litchi" application software, so that many network users no longer visit the plaintiff's website and download the plaintiff's "Penguin FM" client, which seriously infringes upon the copyright enjoyed by the plaintiff to the works involved in the case.

CTOnews.com learned that the court of first instance held that the defendant Litchi Company had infringed upon the plaintiff's copyright and should bear the tort liability for stopping the infringement, eliminating the influence, and compensating the losses, and ordered it to compensate the plaintiff for economic losses of 5 million yuan and reasonable expenses of more than 170,000 yuan for safeguarding rights, and published a statement on its home page for 15 consecutive days to eliminate the impact.

Litchi Company believes that the exclusive license for the adaptation of the "three-body" into a radio play is owned by Himalayan Company, and Liu Cixin did not authorize the right to webcast of the works involved in the case to Tencent, so he filed an appeal. The court of second instance held that the judgment of the first instance found the facts clearly, and although the applicable law was flawed, the judgment was correct, so the decision rejected the appeal of Litchi Company and upheld the original judgment.

In 2019, the litchi of user-produced content (UGC) mode landed on NASDAQ under the stock symbol "LIZHI" and became the "first stock in China's audio industry".

It is worth mentioning that the domestic "three-body" TV series is tentatively scheduled to be broadcast in Tencent Video in September, with a total of 24 episodes.
