On the morning of August 30, Beijing time, it was reported that the National Labor Relations Board (NLRB) ruled on Monday that Tesla should not ban employees from wearing T-shirts with union badges in the factory because it violated the rights of workers.

NLRB asked Elon Musk's electric car company to "stop maintaining and implementing the overly broad team dress policy, which prohibits production workers from wearing black union shirts."

NLRB also asked Tesla to inform employees of the cancellation or modification of the team dress policy and provide a copy of the revised policy.

The decision contradicts the 2019 ruling on Wal-Mart's dress policy. The ruling at the time allowed Wal-Mart to restrict (but not prohibit) employees from wearing clothes with union badges at work.

Two NLRB members opposed Tesla's ruling, while three previously opposed Wal-Mart's ruling.

The majority committee wrote: "when an employer interferes with an employee's right to display a union badge in any way, the employer must prove that their special circumstances can support the legitimacy of such intervention." But Tesla did not prove that he was in this special environment.

Tesla has previously told NLRB that the company's clothing policy is to prevent employees' clothes from scratching the cars or seats they are assembling and to help managers easily judge whether employees are in the right work area.

Tesla's former employees testified on NLRB that Tesla managers had asked them to take off T-shirts emblazoned with UAW badges and slogans, but the clothes did not actually pose a risk to cars and seats.

Neither the UAW nor Tesla could be reached for comment.

Musk has previously tweeted that if Tesla employees want to form a union, they need to give up stock options. NLRB ruled that Musk's move violated US labor law and forced him to delete the tweet, but Musk and Tesla appealed.
