According to reports, the draft law on anti-telecommunications network fraud, which will be submitted to the standing Committee of the National people's Congress for deliberation, stipulates that persons engaged in the crime of telecommunications network fraud and related crimes may be recorded in their credit records in accordance with the relevant provisions of the state. and take corresponding disciplinary measures.

In addition, the third review of the draft will also add more provisions, so as to strengthen publicity and education for the elderly, young people, and other groups, and enhance the pertinence and accuracy of publicity and education; and require enterprises in relevant industries to timely remind users of the emerging means of telecommunications network fraud in this field.

CTOnews.com inquiry found that the 31st meeting of the standing Committee in October 2021 and the 35th meeting of the standing Committee in June 2022 have reviewed the draft law on anti-telecom network fraud twice.

It is reported that in June 2022, the second draft of the Anti-Telecommunication Network Fraud Law was open to the public for opinions, and a total of 12390 members of the public put forward 28406 opinions.

Yang Heqing, spokesman for the legal work Committee of the NPC standing Committee, said: the draft Law on Anti-Telecommunication Network Fraud is proposed to make the following major amendments:

First, on the basis of stipulating the responsibilities of the government and its relevant departments, increase the provisions on people's courts and people's procuratorates to give full play to their judicial and procuratorial functions, to prevent and punish the crime of telecommunications network fraud in accordance with the law, and to increase the provisions for public security organs to establish and improve relevant working mechanisms and strengthen capacity-building.

The second is to strengthen the punishment of criminals of telecom network fraud. Including: additional provisions for persons engaged in telecommunications network fraud crimes and related crimes may be recorded in their credit records in accordance with the relevant provisions of the state, and corresponding disciplinary measures shall be taken; further increase the intensity of administrative punishment on persons who do not constitute a crime; further clarify that telecommunications network fraudsters who, in addition to criminal and administrative liability, cause damage to others in accordance with the law, shall also bear civil liability in accordance with the law.

The third is to strengthen publicity, education and prevention. Including: increase regulations to strengthen publicity and education for the elderly, young people and other groups, enhance the pertinence and accuracy of publicity and education; require enterprises in relevant industries to timely remind users of the emerging means of telecommunications network fraud in this field; stipulate a reward system for the public to report telecommunications network fraud.

The fourth is to improve the appeal system for dealing with fraudulent abnormal situations, increase the provisions that the parties concerned should inform the subject of the disposal reasons and relief channels, and establish and improve the appeal channels in accordance with the principle of who decides and who is responsible.

Fifth, it stipulates that in performing its duties of anti-telecommunications network fraud, the people's Procuratorate may bring a lawsuit in a people's court for acts that infringe upon the public interests of the state and society.
