The penalty shows that in the process of selling cars, the company uses a purchase agreement made by Xiaopeng headquarters in Guangzhou and embedded in Xiaopeng's official App. The agreement states that "if both parties fail to resolve these disputes through consensus, either party shall have the right to submit the dispute to Guangzhou Arbitration Commission for arbitration". Consumers are required to use Xiaopeng Motor App to sign a purchase agreement when buying Xiaopeng Motors, and the terms of the above agreement cannot be changed. The parties rectified the terms of the above agreement in April 2022.

According to the national enterprise credit information publicity system in April this year, Beijing Xiaopeng Automobile sales and Service Co., Ltd. was warned and fined 3000 yuan by the Beijing Chaoyang District Market Supervision Administration for stipulating unfair contract terms and infringing upon consumers' rights and interests.
