CTOnews.com, August 9, the National copyright Administration today issued a notice on the issuance of the interim provisions on the provision of works to people with Reading Disabilities in an accessible manner (hereinafter referred to as the regulations).
According to the regulations, in order to standardize the order of providing works to people with reading disabilities in an accessible manner, and to better facilitate the use of works by people with reading disabilities, give full play to the role of copyright in promoting people with reading disabilities to equally participate in social life and share the fruits of cultural development. These provisions are formulated in accordance with the copyright Law of the people's Republic of China (hereinafter referred to as the copyright Law) and the Marrakech Treaty on facilitating access to published works for the blind, the visually impaired or other printed matter dyslexia approved by China (hereinafter referred to as the Marrakech Treaty).
The provisions point out that in accordance with Article 24, paragraph 1, paragraph 12, of the copyright Law, published works may be made into barrier-free formats and made available to people with reading disabilities without permission or remuneration to the copyright owner, however, the following requirements shall be complied with:
(1) to specify the name of the author and the name of the work
(2) the use of works with legitimate sources
(3) respect the integrity of the work and shall not make any changes other than enabling people with dyslexia to perceive and effectively use the necessary changes.
(4) to mark "only for people with dyslexia" in the title of the work in an appropriate and conspicuous manner.
(5) it is only available to dyslexia or barrier-free format service providers who can provide relevant certificates through specific channels, and services may not be provided or opened to other personnel or organizations.
(6) to take effective measures such as identity authentication and technical measures to prevent access and dissemination by persons or organizations other than people with dyslexia.
(7) the types of accessible formats provided to people with dyslexia should be limited to meeting their reasonable needs.
(8) for the purpose of not making profits
(9) not affecting the normal use of the work by other means or unreasonably harming the legitimate rights and interests of the copyright owner.
CTOnews.com understands that the regulations require that the production, provision and cross-border exchange of accessible formats should inform the copyright owner in an appropriate manner, and record the name of the author, the name of the work, as well as the way and quantity of production, quantity and objects provided, etc., for inspection by the relevant copyright owners and the relevant competent authorities of the State. The relevant records shall be kept for at least 3 years. When recording and providing relevant information, it shall abide by the relevant provisions of the personal Information Protection Law of the people's Republic of China, and equally protect the personal information of people with dyslexia.
The regulations also say:
Institutions such as publishing, film, radio and television, and online audio-visual organizations are encouraged to simultaneously produce and provide barrier-free formats for their copyrighted works.
Encourage the production of accessible formats through accessible format services and provide them to people with dyslexia or other accessible format services.
Encourage the exchange of accessible formats through cross-border exchanges of accessible formats with similar institutions of other parties to the Marrakech Treaty.
