At least for some angry Apple MacBook owners, that development has been given some reassurance, with judges having approved a class-action lawsuit against Apple's fragile butterfly keyboard design.

The lawsuit covers anyone who bought an Apple MacBook with a butterfly keyboard in seven states-California, New York, Florida, Illinois, New Jersey, Washington and Michigan-including anyone who bought a MacBook model between 2015 and 2017 and a MacBook Pro between 2002. MacBook Air between 2016 and 2019 or 2018 and 2019.

According to The Fringe, Judge Edward Davila certified the case in seven subcategories on March 8 in California, but the order didn't take effect until last week. That's an increase in the number of lawsuits filed for the first time in 2018, three years after Apple added butterfly keyboards to laptops, which have been criticized worldwide.

The popular butterfly keyboard is slimmer than apple's past keyboard, which used industry-standard scissors switches. MacBook owners who bought a new device with an ultra-thin keyboard found that the reassembled keyboard failed the moment dust particles (no matter how small) gathered around the switch.

This causes the keys to feel "sticky," unable to register keys at once, and unable to register multiple keys. Apple made several tweaks to its butterfly keyboard, but with constant complaints, they abandoned it altogether in 2020.

Apple has been aware of the flaws in the butterfly key for years, and incremental changes don't solve the core problem, the lawsuit says. The lawsuit cites internal Apple communications, in which one executive wrote: "No matter how much lipstick you try to put on this pig (butterfly keyboard). It's still ugly."

Plaintiffs allege Apple violated multiple laws in seven states involved in the lawsuit, including California's Unfair Competition Act, Florida's Deceptive and Unfair Trade Practices Act and Michigan's Consumer Protection Act. While the lawsuit does not currently require nationwide certification, the law firm behind the lawsuit has invited any U.S. buyers of the affected MacBooks to complete the investigation.

Apple challenged the class-action certificate, saying a full lawsuit should not cover multiple adjustments to the butterfly keyboard.

However, the plaintiffs successfully argued that all butterfly keyboards may have the same basic problem due to their shallow design and narrow gaps between the keys.

The order reads: "Any design differences Apple points out will not change the tight space between buttons or the design's low stroke design. "Apple will have to argue that these basic features don't actually make the design unreliable, and it didn't take the company many years to intentionally create these flawed keyboards.
