Does the bid evaluation committee have the obligation to verify the authenticity of the bid information during the bid evaluation period?

The bid evaluation committee shall have no obligation to verify the authenticity of the bid information during the bid evaluation period, but shall have the right to require the bidder to make necessary clarifications or explanations on the contents of the bid documents that are not clearly defined.

Article 40, paragraph 1, of the Law on tendering and bidding stipulates: "the bid evaluation committee shall evaluate and compare the bid documents in accordance with the bid evaluation standards and methods determined in the tender documents." Therefore, the bid evaluation committee should only conduct objective evaluation against the requirements of the tender documents and the response of the bid documents. The bid evaluation committee has no judicial expertise responsibility and capacity, so it has no obligation to verify the authenticity of the bid information. However, if the tender documents stipulate that the bid evaluation committee reserves the right to verify the bid documents of the bidder, the bid evaluation committee can further verify it based on reasonable doubts about the bid information, which is a right, not an obligation.

In addition, in accordance with Article 39 of the tendering and bidding Law, the bid evaluation committee has the right to require bidders to make necessary clarifications or explanations on the ambiguous contents of the bid documents, however, the clarification or explanation shall not go beyond the scope of the bid documents or change the substantive content of the bid documents.

After the bid evaluation is over, if other bidders object to the authenticity of the bid information of the winning candidate in accordance with the law, the tenderer may organize the original bid evaluation committee to conduct further verification; if the bidder makes a further complaint, the administrative supervision department may conduct another investigation after accepting the complaint.
