Article 50 of the Government Procurement Law clearly stipulates that the parties to a government procurement contract shall not modify, suspend or terminate the contract without authorization. If the continued performance of a government procurement contract will harm the interests of the state and the public, both parties shall modify, suspend or terminate the contract. The party at fault shall bear the liability for compensation; if both parties are at fault, they shall each bear the corresponding liability. Article 67 of the Regulations for the Implementation of the Government Procurement Law stipulates that in any of the following circumstances, the purchaser shall be ordered by the financial department to make corrections within a time limit, given a warning, and the directly responsible person in charge and other directly responsible persons shall be punished according to law and notified: (4) Failure to sign a government procurement contract in accordance with the matters specified in the procurement documents;(6) Unauthorized alteration, suspension or termination of a government procurement contract.
